Terms & Conditions of Service For Can To Curb Service

These Terms and Conditions constitute a legally binding agreement made between you,
whether personally or on behalf of an entity (“customer”, “you”) and Can Concierge, LLC (“Can Concierge, LLC”,  “Can Concierge,” “company”, “we”, “us”, or “our”) as an authorized user of such services provided by the company and any of its subsidiaries.

These Terms and Conditions, together with any operating rules, policies, price
schedules, or other supplemental documents expressly incorporated herein by
reference and published from time to time by Can Concierge (collectively, the “Agreement”), constitutes the entire agreement between Can Concierge and you regarding the bin cleaning service. By using the service, you confirm your acceptance of, and agree to be bound by, this Agreement.

These Terms and Conditions constitute a legally binding agreement concerning your
access to and use of the Can Concierge website,  https://Trashstinks.com, https://canconciergeva.com, or any other affiliated website domain names, as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”). You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms and Conditions.

Service Plans For Can To Curb Service

One-Time Service:

When signing up for the One-Time Service, you agree to have contracted with Can Concierge to move your waste and recycling cans at the address specified for one single trash collection day.  Request and payment must be made at least 72 hours prior to the trash collection day, or service will be performed the following week.  This is a non-recurring Service Contract, and payment is due in advance.

Monthly Service:

When signing up for the Unlimited Monthly Service, you agree to have contracted with Can Concierge to move your waste and recycling cans on each trash collection day (once a week). Request and payment must be made at least 72 hours prior to the trash collection day, or service will begin the following week.  This is a monthly recurring Service Contract, and payment is due in advance of the services to be provided for that month.

Premium Monthly Service:

When signing up for the Premium Monthly Service, you agree to have contracted with Can Concierge to move your waste and recycling cans on each trash collection day (once a week) as well as can cleaning quarterly. Request and payment must be made at least 72 hours prior to the trash collection day, or service will begin the following week.  This is a monthly recurring Service Contract, and payment is due in advance of the services to be provided for that month.

Annual Service:

When signing up for the Annual Service, you agree to have contracted with Can Concierge to move your waste and recycling cans on each trash collection day (once a week) as well as Quarterly Can Cleaning. Request and payment must be made at least 72 hours prior to the trash collection day, or service will begin the following week. This is an annual recurring Service Contract, and payment is due in advance of the services to be provided for that year.

Definitions

  • "Can Concierge" refers to Can Concierge's garbage can management service and any other related services offered by Can Concierge.
  • "Software" means all software (including updates or new versions) and any related documentation we provide for use in connection with Can Concierge services.
  • "Helpers" refers to persons employed or contracted by Can Concierge to provide services.

Home Access

By submitting your service subscription request online, you authorize Can Concierge and its helpers to access your property (or other designated location) to move your waste and recycling cans. You confirm that you have the legal right to authorize such access. It is your responsibility to ensure that Can Concierge or its helpers have full access to your waste and recycling cans on the scheduled service dates. If Can Concierge or its helpers are unable to provide service due to lack of access, no credit or refund will be provided.

Service Description

  • One-Time Service: Can Concierge will move 1 waste can and 1 recycling can to the curb the day before pickup and return them after pick-up on trash collection day.  Additional Cans will be moved for an additional fee.  This includes 2 service visits (one for the curb and one to return).
  • Monthly Service: Can Concierge will move 1 waste can to the curb the day before and return it every trash collection day (weekly) for a flat monthly fee. Additional Cans will be moved for an additional fee per can. This includes 8 service visits per month.  (4 trash days, with 2 movements per day).
  • Premium Service:  Can Concierge will move 1 waste can and 1 recycling can to the curb the day before and return it every trash collection day (weekly) for a flat monthly fee. Additional Cans will be moved for an additional fee per can. This includes 8 service visits per month.  (4 trash days, with 2 movements per day). This includes Quarterly can cleaning for 2 cans plus $10 for each additional can cleaned.
  • Annual Service:  Can Concierge will move 1 waste can and 1 recycling can to the curb the day before and return them every trash collection day (weekly) for 12 months for a flat annual fee.  Additional cans will also be moved for an additional fee per can. This includes 8 service visits per month.  (4 trash days, with 2 movements per day).  This package includes quarterly can cleaning for 2 cans, plus $10 for each additional can cleaned.

Can Access

You must ensure that Can Concierge or its helpers have access to your cans on scheduled service days, including unlocking gates,  providing gate codes, lock combinations, or notifying security personnel as necessary. Pets must be restrained or relocated from storage areas. If Can Concierge is unable to access your waste or recycling cans for any reason, the service will not be performed that week, and no credit or refund will be issued. Can Concierge reserves the right to decline service for any reason.

Pricing

  • One-Time Service: The current fee is $29.95 plus $5 for each additional can and any applicable sales taxes.
  • Monthly Service: The current recurring fee is $34.95 per month plus $5 for each additional can and any applicable sales taxes.  Can Cleaning can be added on for $19.95 per month for 1 can plus $5 for each additional can cleaned monthly.
  • Premium Service:   The current recurring fee is $49.95 per month for 2 cans plus $5 for each additional can, which includes quarterly can cleaning for 2 cans plus $10 for each additional can cleaned and any applicable sales taxes.
  • Annual Service: The current recurring fee is $499 per year (a savings of $400/year), which includes weekly can to curb service for 2 cans plus $5 for each additional can, and quarterly cleaning for 2 cans plus $10 for each additional can cleaned and  any applicable sales taxes.

Can Concierge reserves the right to adjust service fees at any time and will provide 60 days' notice before any changes take effect. If you disagree with the price change, you may cancel your service before the new pricing is applied. If no cancellation is made, the new pricing will apply to the next billing cycle.

Referral Credits

Referral Credits are offered at $10 per referral that subscribes to a monthly, semi-Annual, or Annual Service that is located within 2 miles of your address or within any neighborhood we currently service.  You are responsible for contacting Can Concierge with the referrals name and address following their subscription to receive the credit.  Any credits received will be applied toward your next billing cycle.

Change in Price

While Can Concierge strives to keep pricing competitive, external factors may lead to changes in the cost of service. If there is a price adjustment, Can Concierge will provide you with a minimum 60 days’ notice. You may cancel your service if you do not agree with the new price. Continuing to use the service constitutes acceptance of the new pricing, which shall become a part of this agreement.

Billing & Payment

Service is billed at the start of each month on a recurring monthly basis to ensure uninterrupted service. Unless a specific request is made to cancel, billing will continue monthly.  If there are any applicable local, state, and federal taxes, they will be added to all service fees.

By accepting these terms, you authorize Can Concierge to bill and charge your selected payment method for services, according to the recurring payment plan you choose. Services will automatically renew unless you cancel prior to the next billing cycle, as set forth below.

Cancellation

You may cancel any subscription service with at least 30 days’ notice prior to next billing cycle. Cancellations must be submitted online or in writing to Can Concierge. Once the billing cycle has started, no partial credit or refund will be provided.  Cancellation takes place immediately.

Pets

The homeowner or resident is responsible for containing pets on service days. If a Helper feels unsafe entering the property due to an unsecured pet, the helper will not be obligated to provide the service for that day and no refund will be issued.  Can Concierge is not liable for any incidents involving pets during service visits and you hereby agree to indemnify and hold Can Concierge harmless.

Vehicles

Can Concierge takes great care to place waste and recycling cans in appropriate curbside locations for city pick-up. However, we are not responsible for any damage to vehicles or property caused by vehicles hitting or knocking over waste or recycling cans.

Safety Issues

The homeowner or resident is responsible for maintaining city code compliance with regard to fencing, gates, backwash/waste lines, and other safety regulations.

Customer Satisfaction

Our goal is your complete satisfaction. If a service is not performed to your expectations, you must notify Can Concierge within 7 days (preferably sooner) so that we can address the issue promptly to ensure your continued satisfaction.

Changes to Service

Can Concierge reserves the right to change, suspend, limit, or discontinue any part of its services at any time without notice. If we do suspend or discontinue service, you may be entitled to a credit for any service so suspended or discontinued.  We may also amend the terms of this agreement at our sole discretion by posting revised terms on the Can Concierge website. Continued use of Can Concierge services after the effective date of any revised terms constitutes your acceptance of the new terms.

Disclaimer of Liability

Can Concierge is not liable for any damage to your waste or recycling cans or any property damage due to acts of nature, fire, vandalism, or misuse. We are not responsible for any damage caused to vehicles that may come into contact with your waste or recycling cans.

Recurring Payments Terms & Conditions

By accepting these terms, you authorize Can Concierge to bill and charge your selected payment method based on the payment plan chosen (one-time, monthly, every 6 months, or annually). Your Can Concierge service will automatically renew at the end of each term unless canceled prior to renewal pursuant to the terms of this agreement.

Payments and Payment Method:
You agree that the payment method you select for automatic payments is valid and has sufficient funds. Automatic charges will occur on the billing date for each payment period.

Automatic Renewal:
Your service will automatically renew for the same length as the original term unless canceled before the renewal date.

Current Information:
It is your responsibility to keep your payment method information and email account current at all times during the term of the payment plan.

Payment Declines:
If your payment method is declined, Can Concierge will attempt to process the payment daily for 5 consecutive days. If unsuccessful, your service and this contract may be terminated by Can Concierge without notice.

Cancellation:
You may cancel your subscription service at any time by providing notice on a business day, at least 1 month prior to your next billing date.  If you cancel your enrollment in recurring payments but wish to continue service, you will be responsible for making monthly payments manually at the then price for service.

These Terms and Conditions, together with any operating rules, policies, price schedules, or other supplemental documents expressly incorporated herein by reference and published from time to time by Can Concierge (collectively, the “Agreement”), constitutes the entire agreement between Can Concierge and you regarding the bin cleaning service. By using the service, you confirm your acceptance of, and agree to be bound by, this Agreement.

You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms and Conditions.

  1. Service
    Can Concierge provides a mobile waste bin cleaning service for residential trash bins and commercial trash bins. Residential and Commercial  service will be performed and billed on a subscription basis. Customers will be charged prior to service being performed
  2. Customer Responsibilities
    In order for Can Concierge to provide its services, the customer must abide by the following conditions, or service could be interrupted or postponed, or cancelled.
  • Trash bin(s) must be empty and available by the curb or alley (by the garage door for us to pull down and service) or in an area that is accessible to Can Concierge’s Truck to clean.  If customer lives in a gated community or property, the code must be provided and customer will hold Can Concierge harmless and release Can Concierge of any damages or liability to any and all surrounding property.
  • If customer invites Can Concierge onto the customer’s property or inside
    the garage, then customer is responsible for all damages and
    releases Can Concierge from all liability.
  • Trash bin(s) must be free of all trash and animal waste.  Bins
    containing unbagged feces will not be cleaned.  Every effort will be made to clean the trash bins on trash day.
  • Trash bin(s) must be free of chemicals, oils, any petroleum-based
    products, oil-based paint, glue or other adhesive, or hazardous waste
    of any kind.  Bins containing these substances will not be cleaned.
  • Trash bin(s) must be free of building materials, e.g. plaster, stucco or
    concrete.  Bins containing these substances will not be cleaned.
  • Coastal Clean Bins will not clean damaged bins.  A picture may be sent to the
    customer via email and/or text with a recommendation to replace.

If any of the above conditions are not met, Can Concierge will not perform the service(s) and the customer is still responsible for payment.  If Can Concierge was not able to perform the service, a picture may be sent to the customer via email and/or text
with an explanation.

Additionally, the customer understands that Can Concierge will make every effort to get all debris out of the bins, but certain substances require several treatments to be completely removed. Certain substances are permanent, and some stains can not be removed.

Customer will allow Can Concierge to utilize driveway for cleaning process when necessary for safety reasons. Can Concierge will refuse to work on certain roads that present a danger to employees or assets. The customer’s driveway may be utilized in certain circumstances, and the customer releases Can Concierge from any and all damages.

Customer assumes all responsibility for condition of the bin when not actively being cleaned by Can Concierge or it’s associates. Customer understands that some overspray may occur during cleaning process and releases Can Concierge from any responsibility of damages to property.

Customer may request a rescheduled appointment in the event they are not able to get bins outside for service. Multiple reschedule requests may be denied and a charge may apply to customer’s account in the amount of service.

It is customer’s responsibility to make their empty bins available to be cleaned. Service notifications are sent out in advance via email and/or text message. If Can Concierge does not receive any email, text or phone response to reschedule and shows up to find no bins, full bins, or bins that are not able to be cleaned due to reasons stated above, the customer is subject to a $25 reschedule fee.

  1. Been Cleaned Responsibilities
    Can Concierge will schedule the customer’s service on a pre-planned route and notify the customer prior to service via email and/or text message. Can Concierge will attempt to service all bins on its pre-planned route which should coincide with customer’s trash pick up day. Once the customer’s bins have been serviced, the customer will be charged for the next reoccurring service. The invoice will be paid by credit on file, or by charging the client’s stored credit card. A receipt will be sent by email to the customer.

From time to time, Can Concierge may service bins before trash/recycling has been picked up. In this case, the technician may choose to bag up any trash/recyclables from the bins into a new clean heavy duty bag.  The bins will be cleaned, and the clean trash bag may be reinserted into the clean bins to then be picked up by the customer’s waste hauler.

If Can Concierge is unable to provide its service(s) on the scheduled day due to inclement weather, vehicle maintenance, unforeseen events or otherwise, it will make every attempt to notify the customer in advance and reschedule the customer to the next available opportunity.  Due to route scheduling conflicts and/or extended inclement weather, the service visit may be cancelled until the following scheduled service date. The customer will not be charged if service cannot be performed due to inclement weather or vehicle maintenance.

Winter Weather Policy: Can Concierges’ first priority is the safety of our customers and their property, our employees, and our equipment. At times that will include cancelling appointments due to inclement weather conditions. Can Concierge will attempt to reschedule, but sometimes that may not be possible and a cancellation of that service visit may occur. In the event of a cancellation, a subscription client may have to wait until the next scheduled cleaning visit for service.  At times Can Concierge may not be able to clean the exterior of the bins due to excess water overspray. The inside will still be cleaned, sanitized and deodorized, and the majority of the wastewater will be collected on the truck.  Company policy is that the client will not be charged unless service has been completed.  In the event of a cancellation or reschedule due to weather, the client will be notified via email and/or text. Can Concierge will not be held responsible for frozen water left behind from the cleaning process and the client hereby releases Can Concierge from any liability.

  1. Charges

The customer agrees to pay all charges for the service(s) and any applicable taxes. Can Concierge reserves the right to adjust pricing at any time. Changes in pricing may be communicated to the customer via updates to the website and/or email. It is the customer’s right to choose to continue or discontinue the service at any time. The service will continue on a recurring basis until cancelled by the customer. Customers may request a change to the selected service plan 7 days in advance of the next scheduled service.

Service Based Payment (Pay as you go):

  • Customer must have a Debit Card or Credit Card stored on file, and have accepted automatic future charges.
  • Customer will be billed/charged prior to each completed service visit.
  • Customer is responsible for paying for the service requested regardless of the number of bins present and available for cleaning.
  • An invoice is created after each service.
  • Payment is automatically collected after each service for the next service.
  • A receipt will be sent to the customer via email after each service.
  • Service is ongoing until customer cancels service.

Pre-Payment:

  • Customer must have a Debit Card or Credit Card stored on file, and have accepted automatic future charges.
  • Pre-Payment charges will be made in advance of the first cleaning.
  • Customer’s account will maintain a credit that will be drawn down after each service visit until depleted.
  • Customer is responsible for paying for the service requested regardless of the number of bins present and available for cleaning.
  • A receipt will be sent to the customer via email after each service to keep customer informed of current balance available on account.
  • Once customer’s account is depleted, Can Concierge will automatically charge the customers for another 12 month period of service, or convert the customer to pay as you go for same service interval. A pricing adjustment may be necessary.
  • Service is ongoing until the customer cancels service.

Can Concierge will utilize industry leaders in payment processing to safely and securely store customer’s credit card information. Customer’s card will be run automatically after service, and a receipt will be sent via email.

  1. Referral Program

Existing subscription customers in good standing may be eligible to receive a referral fee for referring a new first time paying subscription customer. Existing customer will forfeit the free cleaning credits if they cancel their existing subscription after receiving free cleaning credits before utilizing the free cleaning credit. If the existing customer cancels subscription after utilizing the free cleaning credits but before paying for another subscription cleaning, they are subject to a charge for each cleaning that was free (equal to the subscription price). Can Concierge reserves the right to terminate the Referral Program at any time.

  1. Modifications to Terms and Conditions and/or Customer Agreement

Can Concierge reserves the right to modify and/or amend the Terms and Conditions and/or the Customer Agreement at any time by posting a revised Terms and Conditions and/or the Customer Agreement at www.canconciergeva.com, and/or sending information regarding the amendment to the email address you provided to Can Concierge.

  1. Modifications to Service

Can Concierge reserves the right to modify the service at any time for the betterment of our customers and the overall success of the service program. Customer may adjust service frequency at any time and will accept the price difference to do so.

  1. Default Payments

Can Concierge reserves the right to suspend or terminate your service without notice upon rejection of any credit or debit card charges, or if the customer’s card issuer (or its agent or affiliate) seeks return of payments previously made to Can Concierge. Such rights are in addition to and not in lieu of any other legal rights or remedies available to Can Concierge.

  1. Cancellation of Subscription Service

The customer may cancel a subscription service at any time.  If subscription cancellation occurs after only one cleaning visit, the customer will be charged the minimum service fee which is the equivalent of the One Time Cleaning Rate for the number of bins cleaned.  Cancellation must occur 14 days in advance of next scheduled service date.  Pre payment refunds are not issued for cancellation of service.

  1. Customer Information

We do not sell, trade, or rent customer’s personal identification information to others. Can Concierge utilizes industry leading PCI compliant credit card information storage through their payment processor.

  1. Sanitization and Disinfection

The customer understands that Can Concierge high pressure hot water is a great defense against germs and the environments they thrive in, but that Can Concierge cannot guarantee the complete elimination of all contagions within, around and on garbage bins. Can Concierge will make all reasonable efforts to sanitize and disinfect to the best of their ability, but makes no claims to prevent disease and/or the spread of germs.
